How to get my green card through marriage if I'm living outside of USA?

Burt Cheevers: You can't get your greencard, but you can do this a different way. Your bf can apply for a "Fiance" visa. This will give you a visa to enter the country to get married (You have 2 months to get married after entering the country). After marriage, you can apply for your green card, and will get "temporary" residency. This will last for 2 years, and be converted to permanent residency.

Jonathon Labonne: Your child has a claim to US citizenship through his father, but the father has to register his "birth to a US citizen while abroad" at the nearest US consulate. He needs the child's birth certificate listing both parents and their citizenship, his proof of US citizenship, baby, baby's passport photos, etc. Since you two are not married, he probably has to prove paternity -- DNA tests all around. The child, provided the father properly proves citizenship and registers the birth at the consulate, cannot do diddly for you. A child must be over 21 to sponso! r a parent. Your boyfriend cannot do diddly for you either. There's no such thing as a boyfriend or girlfriend visa. If in the future you two decide to marry, he can apply for a fiance visa for you. If approved (takes about a year now), you can enter the US and have 90 days to marry and apply for change of status to a spousal visa. No marriage within the 90 days, you go home and stay there. If you marry in Canada, then he can apply for your spousal visa. That can take about 2 - 2-1/2 years. The ball is in his court. You are not going anywhere, and at this point, neither is baby....Show more

Janean Guz: In your situation the K1 Fiance visa might be problematic. You would have to arrive in the US, get married, THEN apply for adjustment of status (a green card) and an EAD in order to work. The time frame should be faster if you get married, return to Brazil, File for a CR-1 visa. After you arrive in the US you should get your green card in the mail in 4 to 12 weeks. You s! hould also get an I-551 stamp in your passport. Take it to the! SSA office and get a SSN. You then can work without waiting for all the paperwork.Good Luck!...Show more

Michel Mccaulley: Your US Citizen fiance has to file K1 Fiance visa Petition first. Once you come to US on K1 then you have to get married in 90 days, then you file Adjustment of Status to get green card. You cannot get green card outside of US, but you can get immigrant visa to come to US and get green card. http://travel.state.gov/visa/immigrants/types/type...http://www.uscis.gov/portal/site/uscis/menuitem.eb...http://www.visajourney.com/content/k1guide...Show more
